    Discussion summary
    This bill amends the current law that provides the right of first refusal for the former owner of a property when the property is not used for the project or purpose for which it was taken by eminent domain. This bill requires that the price to be paid by the former owner must be equal to the price paid to the owner when the property was taken; no adjustments are made for improvements or inflation.

    This bill also prohibits the condemnation of property occupied by a business in excess of what is absolutely necessary for the project or purpose for which the power of eminent domain is exercised.

    Last session, LD 1741  S.P. 658 An Act To Encourage Reporting of Potential Fraud, Waste, Inefficiency and Abuse in State Government was passed. It served to assure confidentiality to "whistleblowers" in order to encourage them to come forward without being penalized (in theory).

    There is another incentive in use at the Federal level (False Claims Act) which Maine should adopt - often referred to as "Qui Tam".

    Certainly there would also be benefit to be derived from replicating the Federal False Claims Act here in Maine.

    Qui Tam ("who sues on behalf of the king as well as for himself") is a provision of the Federal Civil False Claims Act that allows a private citizen to file a suit in the name of the U.S. Government charging fraud by government contractors and other entities who receive or use government funds, and share in any money recovered.

    Qui tam has been, and continues to be, a very effective and successful tool in combating government procurement and program fraud. Bolstered by amendments passed by Congress in 1986, this law has armed private citizens, who have independent and direct knowledge of fraud, with a weapon to prosecute government contractors, and others who are defrauding the Government, and share in the recovery.

    Something along these lines would provide a more complete shield against fraud whether it comes at the State or the Federal level of program services and operations.

    The reason the State should enact it's own version of qui tam is because the courts have often held that state entities are exempt from the provisions of these Federal laws constitutionally. So if a State employee or a State contractor was ripping off the State, they couldn't be prosecuted under the Federal laws. Additionally, if a municipality or other political subdivision was defrauding the State OR the Fed on programs or fees, the Federal FCA wouldn't apply. Qui tam provides a financial incentive for insiders to come forward with suspicions of frauds.

    Discussion Hi Sean,

    This act might be easier to accept if instead of requiring girls to have the vaccine, you simply give them a voucher to have the vaccine free at some time, now or in the future, of their choosing. I believe that forcing people to do anything no matter how beneficial is NOT the role of a democratic government. By simply offering the option it might reduce any liability if it is discovered that a) the child has a negative reaction, or b) the medication causes long-term unexpected consequences.

    Hi Ethan,
    I'm not sure what the genesis of this bill is but I wonder if you have calculated the costs of changing the name. Besides the building signage (inside and out) and letterheads, contract forms, asset valuation reports, computer system changes, website changes, etc. etc. please take into account the fact that everybody who has anything to do with MSRS has their own files, folders, Quicken, MS Money and other records all set up for MSRS. Think of the thousands of people who will have to change their books.

    Is it really that important a change to justify spending that much money on?

    The Retirement System asked me to put the bill in.  It is courtesy for the Chair to submit bills on behalf of the Departments we oversee, since they
    are unable to do so.  Once we actually hear the bill, we will get the why's, wherefore's, and cost estimates.  At that point I'll have a better sense of
    whether this is worthwhile.

    Discussion summary
    This bill amends the adverse possession law and makes it consistent with the original intent of the Legislature and with the holding of Dombkowski v. Ferland. 2006 ME 24

    Edgar R. Ferland appeals from a judgment entered in the Superior Court (Waldo County, Hjelm, J.) granting Marion J. Dombkowski title by adverse possession to a disputed parcel of land to which Ferland holds record title, and enjoining Ferland from interfering with Dombkowski’s use, possession, and enjoyment of the land. Ferland contends that: (1) the court erred in applying and interpreting 14 M.R.S. § 810-A (2005); (2) the court abused its discretion in admitting in evidence the entire transcript from the hearing for a preliminary injunction; and (3) there was insufficient evidence for the court to find actual possession and use of the entire disputed parcel for the twenty-year period required for an adverse possession claim. We disagree and affirm the judgment.

    Discussion summary
    This bill establishes the criteria for determination of compensation for loss or impairment of the going concern value of a business when the property of a business is taken by the Department of Transportation or a municipality exercising its eminent domain power. The burden is on the business to prove the loss. The analysis takes place at the request of the owner of the displaced business. The process requires both the owner and the governmental authority to each select a licensed appraiser to make the determination of the loss or impairment of the going concern value. If they agree, that additional compensation must be added to the compensation offer. If they disagree but are within 10% of each other, the average appraisal is used. If they disagree by more than 10%, the owner may ask the State Claims Commission to apply the same analysis when the owner appeals the offer. This process applies to compensation to be paid by municipalities when exercising eminent domain authority under general authorization provisions and for economic development purposes.

    This bill amends the duties of the State Claims Commission to include determination of just compensation in 2 categories of municipal condemnations: general eminent domain authority under the Maine Revised Statutes, Title 30-A, chapter 151 and community development under Title 30-A, chapter 205.

    Rep. Holman - in many ways Symantec and I do agree. They also point out that the definition of spyware used in the proposed legislation does not differentiate between good spyware vs. bad spyware. And the difference is very significant. How can anyone except people with expertise determine what "spyware" should be punishable. I've worked with computer technology since 1979 and I still have trouble with this. So who will be the spyware Proctor?

    Does anyone believe that the courts will want to wrestle with any definition of spyware with each and every case? The nature and actions of "spyware" changes constantly. The courts couldn't keep up except with great expense. I sent you the "humanclick" example from the Legislature's ANPH. Is that spyware snippet covered under this act? Ouch - rewrite the entire State website then because it tracks usage information extensively.

    What do you do when a specific feature on a website REQUIRES that you permit it's spyware snippet in order to use that feature - and you really, really want to use that feature? Then, two weeks later, having forgotten the agreement to accept that snippet, you file a claim under this legislation - incurring costs for everyone only to find out months/years later that - oooops, I forgot. When I have worked on computers for home users, I am always hearing "I never installed that!"

    I agree with most of Symantec's recommendations for amendments, but my biggest concern is who, what, when, where and how on Earth is anyone going to be able to enforce this upon ever-changing technology.

    This is unenforceable. Where is the fiscal note?

    Now - if you want to go after someone on spyware - go after Microsoft for designing software that permits your computer to be taken over by spyware, viruses, hackers, etc. Windows has always been considered defective and MS specifically includes a disclaimer in their EULA as to it's disfunctionality.

    Would you buy a car if everyone else had a skeleton key? If GM or Toyota disclaimed any liability for whether it worked or not - other than as a lawn ornament?

    I apologize for not being able to attend the Public Hearing on this bill. However, I am a Microsoft Certified Systems Engineer and do possess a certain amount of expertise in this area. Let me share what I know regarding this bill.

    It is completely unenforceable.

    Much Spyware is detrimental, but some is highly valuable and in fact necessary. Almost every website you visit puts a "cookie" on your computer. A cookie is a small file that stores info about you - on your computer as opposed to on the websites computers. A cookie must be authorized by you before the info is stored. A typical cookie stores information which will save you from having to enter certain data every time you visit the website. It might also store data on your purchasing or browsing history - this is intended to better offer you relevant information.

    Cookies are defined as spyware but should be excluded from this regulation.

    Senator Peter Bowman made reference to seeing the hard drive light blinking when the computer is idle, and implied that that might be caused by spyware. This is more likely to be caused by the Windows Indexing Service which runs in the background only when the system is idle.

    The effects of truly unfriendly Spyware can be blocked by properly implementing a Firewall, either Windows firewall or a private firewall from Symantec or others. Plus, if you use a router, most current routers have built-in firewalls.

    So in summary, I propose that what is most needed is education and not legislation. Some legislation has negative unanticipated consequences. This legislation has anticipatible negative consequences - if it were enforced.

    I will try to be at the work session if you would like a technical explanation of the issues within LD 1029.
